These Terms of Conditions ("Terms") govern your access to and use of the website and quote-request service (the "Service") operated by APDREAM LLC, doing business as Local AC Help ("Local AC Help," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Local AC Help operates an online quote qualifier that collects information from homeowners and businesses interested in HVAC installation, replacement, repair, or maintenance services, and shares that information with independent, third-party HVAC contractors and service professionals ("Partner Contractors") for the purpose of providing quotes.
Local AC Help is not a licensed HVAC contractor and does not perform, supervise, warranty, or guarantee any HVAC installation, repair, or service work. We do not employ, endorse, or control Partner Contractors. Any agreement for HVAC services is solely between you and the Partner Contractor you choose to engage.
2. Eligibility
You must be at least 18 years old and have the legal authority to request services for the property in question (as an owner, authorized tenant, or authorized business representative) to use the Service.
3. No Guarantee of Match or Service Quality
We do not guarantee that you will be matched with a Partner Contractor, that any Partner Contractor will contact you, or that any quote, estimate, or work performed by a Partner Contractor will meet your expectations. We do not verify, and are not responsible for, the licensing, insurance, workmanship, pricing, or conduct of any Partner Contractor. You are responsible for independently vetting any contractor before engaging their services.
4. Communications Consent, Including SMS/Text Messages
Consent to Contact. By submitting your information through the Service, you expressly consent to be contacted by Local AC Help and/or Partner Contractors by phone (including automated dialing or pre-recorded messages), SMS/text message, and email regarding your quote request, using the phone number and email address you provide, even if that number is on a state or federal Do-Not-Call registry.
SMS Consent. By providing your phone number and submitting a request, you agree to receive SMS/text messages from Local AC Help and/or Partner Contractors related to your quote request, scheduling, and related follow-ups. Consent to receive SMS messages is not required as a condition of using the Service or of any purchase.
Message Frequency. Message frequency varies depending on your request and the number of Partner Contractors matched to you.
Message and Data Rates May Apply. Message and data rates from your wireless carrier may apply to any SMS messages you receive. We are not responsible for carrier charges.
Opt-Out and Help. Reply STOP to any text message at any time to opt out of further messages from that sender. Reply HELP for assistance, or contact support@localachelp.com. Opting out of messages from Local AC Help does not automatically opt you out of communications from a Partner Contractor you have separately engaged; you may need to opt out with them directly.
5. Fees
The Service — meaning the submission of your request and matching with Partner Contractors — is provided to you at no cost. Local AC Help is compensated by Partner Contractors, not by users of the Service. Any fees for actual HVAC installation, repair, or service work are determined solely between you and the Partner Contractor you engage.
6. User Responsibilities
You agree to provide accurate, current, and complete information when using the Service, and not to use the Service for any unlawful, fraudulent, or abusive purpose, including submitting requests on behalf of a property or phone number you are not authorized to represent.
7. Intellectual Property
All content on the Service, including text, graphics, logos, and software, is the property of APDREAM LLC or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any content from the Service without our prior written consent.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY MATCH WITH A PARTNER CONTRACTOR WILL RESULT IN SATISFACTORY WORK.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, APDREAM LLC DBA LOCAL AC HELP, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY INTERACTION WITH A PARTNER CONTRACTOR, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
10. Indemnification
You agree to indemnify and hold harmless APDREAM LLC dba Local AC Help and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your engagement with any Partner Contractor.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Hawaii, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at support@localachelp.com. If a dispute cannot be resolved informally, it shall be resolved through binding individual arbitration, and you waive any right to participate in a class action lawsuit or class-wide arbitration, to the fullest extent permitted by law.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, Partner Contractors, or Local AC Help.
13. Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page with a new "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
